BidKar is a demonstration project. No money moves — payments are simulated end to end, and nothing you do here creates a debt or transfers ownership of anything. No identity documents are stored: an Aadhaar number is checked in memory and discarded, and there is no column in this database that could hold one. These are not temporary limitations. Holding customer funds in India requires a Payment Aggregator licence from the Reserve Bank, and storing Aadhaar numbers engages the Aadhaar Act 2016.
This page is not legal advice. It describes what the software does. A real deployment would need a lawyer to review it.
1. What an auction here is
A seller lists an item and chooses how long bidding runs, between one hour and one month. An administrator reviews the listing before it appears publicly. The highest bid when the clock runs out wins, and the winner has 24 hours to pay. If they do not, the lot is offered to the next bidder at their own bid, and the seller decides whether to accept it.
The server's clock decides everything. The countdown in your browser is an animation; the only time that counts is the database's.
2. Bids are binding, and permanent
A bid is an offer to buy at that price. It cannot be retracted, and it is never deleted or edited — the bid record is append-only and exists precisely so that a disputed result can be settled by looking at what actually happened.
Bidding requires a verified account. So does listing an item. That check happens once per account, not per item.
3. What a seller affirms, per item
Before a listing goes to review, its seller affirms the following about that specific item. Not about their account in general — a tick at signup cannot say anything true about an object that did not exist yet.
- 01 This is a demonstration, and no sale actually happens. BidKar is a demonstration project. No money moves, no payment is ever collected or held, and nothing here creates a binding contract of sale between you and any buyer. Bids, orders and deadlines behave like the real thing so the system can be shown working. Do not list an item you are not prepared to see treated as fictional, and do not expect to be paid.
- 02 The item is yours to sell. You own this item outright, or you are authorised by its owner to sell it. It is not stolen, not the subject of a dispute, and not pledged, mortgaged, hypothecated or held under a hire-purchase or loan agreement that would prevent you transferring it.Sale of Goods Act 1930, s.14 — implied condition as to title
- 03 The item is lawful to sell. It is not a weapon, ammunition, explosive or hazardous chemical; not a narcotic or psychotropic substance; not a wildlife product or anything restricted under CITES; not tobacco, an e-cigarette or a vaping product; not a prescription drug or regulated medical device; not an antiquity or art treasure; not adult content; not a map misrepresenting India's borders; and not personal data or a database of it.Arms Act 1959 · NDPS Act 1985 · Wildlife Protection Act 1972 · Drugs and Cosmetics Act 1940 · Antiquities and Art Treasures Act 1972 · the 2019 nationwide ban on e-cigarettes
- 04 It is genuine, and not counterfeit. The item is not a counterfeit, replica or unauthorised copy, and listing it does not infringe anyone's trade mark, copyright, design or patent. If it is branded, it is what the brand on it says it is.Trade Marks Act 1999 · Copyright Act 1957 · Designs Act 2000
- 05 The description is true, including the faults. The title, description, condition and photographs describe this item accurately. You have disclosed every defect, repair, missing part and functional problem you are aware of. You have not overstated the condition, and the photographs are of this item — not stock images, and not a different unit of the same model.Consumer Protection Act 2019, s.2(28) — misleading advertisement · Consumer Protection (E-Commerce) Rules 2020, r.6(5)
- 06 You will not manipulate the bidding. You will not bid on your own listing, arrange for anyone else to bid on it to raise the price, or place bids with no intention of completing. Doing so is a false representation to every other bidder.Consumer Protection Act 2019 — unfair trade practice
- 07 If you supplied a bill, it is the real one. Any purchase bill you upload is a genuine document, relates to this item, and the date and amount you stated are what it actually shows. You understand that an administrator checks it, and that if the item sells the document is given to the buyer — so you have removed anything on it you are not willing to hand over. You have not uploaded an Aadhaar card, a PAN card, or anyone's identity document.Aadhaar Act 2016, s.29 · DPDP Act 2023
- 08 Someone else's personal data is not yours to publish. Nothing you upload contains another person's name, address, phone number, identity number or photograph without their consent.DPDP Act 2023
- 09 Your own taxes are yours. You are responsible for any tax arising from selling this item, including GST registration where your turnover requires it and income tax on any gain. Because no money moves through this demonstration, nothing is collected or withheld on your behalf. A real marketplace would collect tax at source on your payouts and deduct TDS.CGST Act 2017, s.52 — TCS · Income-tax Act 1961, s.194-O — TDS
- 10 You are anonymous to buyers, not to us. Buyers see a handle, never your name or contact details. BidKar holds your identity internally and will disclose it where the law requires — to a court, to a regulator, or to a law-enforcement request. If the item sells and you supplied a bill, the buyer receives that document and whatever it reveals about you.Consumer Protection (E-Commerce) Rules 2020, r.5(3) — seller disclosure; see docs/COMPLIANCE.md §5 for the unresolved tension here
- 11 What happens if any of this is untrue. The listing can be removed at any time, before or after bidding starts. A serious or repeated false statement results in a strike against your account: one strike suspends it, a second is permanent. You remain responsible for any loss BidKar or a buyer suffers because you declared something that was not true.
- 12 You are making these statements yourself. You have read the above, they are true as far as you know, and you are the account holder submitting this listing.
4. Anonymity, and its one exception
Buyers and sellers see each other only as handles. This site stores no phone numbers for anybody, and an email address is never shown to another user.
The exception is collection. A delivery partner has to travel to a seller's door, so an address exists and is visible to the one partner assigned to that job, and to administrators. It is never visible to the buyer. Where a purchase bill has been verified, the buyer receives a copy once the order is paid — which is a deliberate end to the seller's anonymity, consented to at upload, in those words.
5. Prohibited items
Weapons, ammunition and explosives; drugs and controlled substances; wildlife products; human remains or organs; counterfeits; stolen goods; antiquities that cannot lawfully leave India; and personal data are not permitted. A listing is checked against this list before it goes live, and removal is at the administrators' discretion.
6. Accounts
Accounts may be suspended or banned for failing to pay, for repeated misdescription, or for anything in §5. Sanctions follow a strike ladder rather than a single judgement, and an upheld provenance dispute counts as a strike.
Questions about how any of this is enforced are answered in the repository's docs/COMPLIANCE.md, which cites the statute behind each rule. About BidKar
